She is a versatile and strategic advocate who brings experience in large scale commercial arbitrations and has appeared before several levels of court in Canada. Overview Daphne has a general commercial litigation practice with a focus on complex commercial disputes. Her experience includes advising clients and resolving contractual and other high-value disputes in the energy, intellectual property, commercial lands, tax, construction and transportation sectors. She has represented clients before all levels of court in Alberta, the Saskatchewan Court of King’s Bench, the Federal Court of Canada and the Supreme Court of Canada. She has also represented corporations in large-scale commercial arbitrations. Daphne is a practice group leader at The Advocates' Society Arbitration & Mediation Advocacy Practice Group. Prior to joining Bennett Jones, Daphne articled at the Alberta Court of Appeal and worked at another major national law firm. Recent Experience • Teine Energy on: 1) an application to enforce, and resist an application to stay, an arbitration award of approximately C$80 million against Inter Pipeline relating to the breach of an agreement for the transportation of Teine Energy's light crude oil on the Mid-Saskatchewan Pipeline System (Inter Pipeline Ltd v Teine Energy Ltd, 2024 ABKB 740); and 2) successfully opposing an application from Inter Pipeline Ltd. to set aside and for leave to appeal an arbitration award (Inter Pipeline Ltd v Teine Energy Ltd, 2026 ABKB 524) • Shopify in its successful opposition in the Federal Court of two CRA applications for Shopify to divulge business information about its merchants • IFP Technologies (Canada) Inc. ("IFP"), in the $60-million law suit of the predecessors to Ovintiv Canada ULC and Cenovus Energy (collectively, "Ovintiv") based on the alleged improper development of the Eyehill Creek oil field and failure to observe IFP’s contractual rights to refuse a disposition to a third party: 2024 ABCA 384; 2022 ABKB 807 |
